The following terms are used in this document:
MetroComputer, meaning the owner, representative(s) and/or employee(s) of MetroComputer.
Client, meaning the customer(s) dealing with MetroComputer.
Service, meaning the service(s) supplied by MetroComputer to the Client.
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.
We at MetroComputer highly value customer satisfaction. If at any time your experience is less than outstanding, we will do our best to make it right.
Our 30-day return policy gives you plenty of time to consider your purchase. That’s why you can be sure that you made the right decision.
If for any reason you are not satisfied with your purchase, you can return any item in its original condition within 30 days of the date of shipment for a refund or an exchange. Sorry, there are NO REFUNDS after 30 days and NO REFUNDS on labor or shipping charges.
Release of Liability:
CLIENT AGREES TO RELEASE AND HOLD HARMLESS METROCOMPUTER FROM ANY AND ALL LIABILITY ASSOCIATED WITH THE PERFORMANCE OF SERVICE OR THE PROVISION OF PARTS, AND ACKNOWLEDGES THAT METROCOMPUTER OFFERS NO EXPLICIT OR IMPLIED WARRANTY OR GUARANTEE ON SERVICES PERFORMED OR PARTS PROVIDED, OTHER THAN THE MANUFACTURER’S WARRANTY.
Client grants MetroComputer, its agents and service representative’s access and permission to physically disassemble any and all computer systems, components, networks, cabling, hubs, routers, switches, peripherals, and accessories.
Client grants MetroComputer, its agents and service representatives access security rights, and permission to open, view, and modify, edit, delete, or otherwise manipulate Clients computer software, applications, data, and data storage media including, but not limited to the computer Operating System, word processing, spreadsheets, databases, workflow, graphics, audio, video, system drivers and libraries, and any other type of software or data that may be contained on Clients computer system or network.
Client grants MetroComputer, its agents and service representative, permission to download and/or install software on Clients computer and/or network, including but not limited to, virus scanners, diagnosis and repair utilities, drivers, libraries, and software requested to be installed by Client.
Client grants MetroComputer, its agents and service representative, permission to install hardware in Clients computer and/or network, including but not limited to, memory chips, processor chips, cooling fans, batteries, hard drives, tape drives, storage devices, modem and communication devices, audio and video cards, network interface cards, hubs, routers, switches, printers, scanners, cables, and other hardware requested to be installed by the Client.
Time in Transit
MetroComputer cannot guarantee transit times. Ground shipping is generally 2-5 business days each way within the lower 48 states. Next Day shipping is generally delivered the following business day. Orders shipped to Alaska, Hawaii and some remote areas may be delivered 2nd Day. Fedex will send notification if weather or other conditions may cause a delay to your shipment. You will always be provided with tracking numbers to monitor and track your shipment.
MetroComputer is not responsible for any loss or damage while your computer is in transit.
Fedex sells insurance to the nearest $100 for a nominal fee. For example, if your item was $150, you should insure it for $200. Insurance will give you the peace of mind that if something should happen to your return during transit, you will be reimbursed by the shipping company.
Insurance fees are excluded in shipping charges, and therefore are the responsibility of the customer. Insurance claims require a proof of purchase (original receipt or credit card statement) before a reimbursement can be made. Insurance claims are approved by the shipping company.
All packages containing laptops shipped from our facility require a signature from you or an authorized recipient upon delivery. If you wish not to require a signature upon delivery, you agree to release MetroComputer from any liability for damages or loss discovered during or upon the return of your laptop. An electronic agreement to release MetroComputer of liability will be required by you, the recipient, and will be kept in our records.
Once the diagnostic is complete on your computer, a MetroComputer technician will contact you with the results. Upon MetroComputer receiving of your laptop, desktop computer, iPhone, or iPad, and if after 30 days you have not contacted MetroComputer, your computer will be considered abandoned and MetroComputer will have sole discretion as to its disposal. We will make several attempts to contact a customer via phone and email prior to considering a machine abandoned.
Typographical Errors and Information Policy
MetroComputer is not responsible for any typographical errors. We reserve the right to modify, change and/or update any information contained on this Web site (The “Site”) at any time without prior notification.
In the event that a MetroComputer, LLC product is mistakenly listed at an incorrect price, MetroComputer, LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. MetroComputer, LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, MetroComputer, LLC shall issue a credit to your credit card account in the amount of the incorrect price.
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Mission Repair, LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.
MetroComputer collects personal information at the time you submit a service order. Personal information includes your name, email address, shipping and billing address, phone number, and other personally identifiable information about you. Your personal information is used solely by MetroComputer to fulfill your request for services and to contact you regarding those services. We do not sell, trade or transfer your personal information outside our company unless specifically requested by you.
Security and Confidentiality
Non-public information about you is restricted and can only be accessed by those employed by MetroComputer who need to know your personal information for the purpose of fulfilling your service request(s) and to service your account(s) with us. If you choose to submit a service order, the transmission of your personal information will be protected by an encryption process.
While we take great care to protect customer data, MetroComputer is not responsible for any data loss that may occur in shipping, during the repair process, or at any other time. Prior backup is a customer responsibility and MetroComputer cannot guarantee (although we work hard to protect) the security and/or privacy of your data.
To the fullest extent permissible pursuant to applicable law, MetroComputer, LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. MetroComputer, LLC does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. MetroComputer, LLC does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.
THERE IS NO WARRANTY FOR THE REMOVAL OF VIRUSES, SPYWARE, ADWARE, and/or MALWARE. IF THEY ARE A CAUSE OF REPEAT EFFORT, THEN YOU WILL BE CHARGED AGAIN FOR THAT SERVICE.
MetroComputer, LLC may send and deliver notice to you by means of e-mail or by other reliable method, such as written correspondence via United States Postal Service and/or Federal Express, to the address you have provided to MetroComputer, LLC.
Your use of this site shall be governed in all respects by the laws of the state of Georgia, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of MetroComputer, LLC products) shall be in the state or federal courts located in Fulton County, Georgia. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Mission Repair, LLC products) must be commenced within one (1) year after the claim or cause of action arises. MetroComputer, LLC’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. MetroComputer, LLC may assign its rights and duties under this Agreement to any party at any time without notice to you.
By reading this document and/or entering into service(s) or sale(s) withh MetroComputer, Client indicates that he/she has read and understands, and agrees to the terms of this Payment Terms and Release of Liability form, which is kept on file at the offices of MetroComputer.
